>Compliance Verification of Alternative Security Programs for MTSA Regulated Vessels and Facilities

>Feedback from the maritime industry has indicated that some Coast Guard units may be incorrectly applying the provisions of 33 CFR 104 and 105 when conducting Maritime Transportation Security Act (MTSA) compliance exams of commerical vessels and facilities that use approved Alternative Security Programs (ASP). In response, the Coast Guard Office of Vessel Activities (CG-543) and Office of Port and Facility Activities (CG-544) released a joint message, COMDT COGARD Washington DC 041631Z Sep 09, to field units reminding them that an approved ASP is an alternative way to comply with MTSA and is not intended to match each individual regulation of Part 104 and 105. An ASP is approved on the basis of a holistic ability to meet the intent of MTSA as appropriate for a specific industry segment. Coast Guard Sectors and subordinate marine safety units should review this message.
